In order to inform the interested party in as clear and straightforward a way as possible, Metro Málaga uses a layered information system.  This means when the interested party provides Metro Málaga with their personal data, they are offered basic information, in a straightforward and concise way, about how the data will be processed.  At the same time, they will be advised where they can obtain more detailed information if they so wish.

This privacy policy includes, in the most detailed form possible, all the information applicable to the processing of personal data of users and third parties carried out by Metro Málaga.

  1. Replacement/Complimentary rail tickets. Metro Málaga will process data provided by the user in respect of replacement/complimentary tickets in order to issue them.

  1. Payment of final and total compensation. Metro Málaga will process the data provided by the user in the cases of requests for payment of compensation in order to manage such requests.

  1. Requests to carry out activities, take photographs or make recordings in any Metro Málaga premises. Metro Málaga will process the data of those users who make requests to carry out the above activities in any Metro Málaga premises, in order to manage such requests.

  1. Requests to participate in activities organized by Metro Málaga (Metro School, Metro Senior, or similar). Metro Málaga will process the data of those users who make requests to carry out activities in any Metro Málaga premises, in order to manage such requests.

  1. Claim and complaints form (the official Junta de Andalucia form). Metro Málaga will process the data provided by the user when they complete a claims and complaint form in order to be able to manage and respond to it.

Legal basis: Metro Málaga’s legal obligation in respect of current consumer and user legislation.

 

  1. Notification of infractions of the Rules and Regulations of the Service. Metro Málaga will process the data of the user in order to notify them of infractions of the Rules and Regulations of the service.

Legal basis: Metro Málaga’s compliance with its legal obligations in respect of transport and safety.

 

  1. Notification of extra charge. Metro Málaga will process the user’s data in order to notify them of extra charges as a result of infractions of the Rules and Regulations of the service.

b)  Marketing material.

Metro Málaga will be able to request the user’s consent in order to issue general or personalized marketing material (news letters) through any media, including email, text messaging or any other electronic communication.

Legal basis:  The user’s consent.

In all cases, the user may object to the sending of such marketing material by indicating in the relevant box, or later, can withdraw their consent by writing to the following email address: dpd@metroMálaga.es

c)  Video surveillance.

Metro Málaga has video surveillance systems that capture images through different devices located in its facilities.

The legal basis for this is the public interest in order to maintain the safety of people, property and facilities.

The images obtained are kept for 30 days, in accordance with current legislation, except where another period of time is established by legislation.

d)  Communications through intercoms.

Metro Málaga has an intercom system in its facilities for use in case of emergencies.

Should a user activate the emergency handle, the conversation between the user and Metro Málaga staff will be recorded, for security reasons, and stored for the period of time required under current legislation.

The legal basis for this processing is the legal interest of Metro Málaga in order to maintain the safety of people, property and facilities.

  1. Accuracy and truthfulness

Metro Málaga considers truthful and accurate the personal data provided by the interested party, not answerable, therefore, for any damage that the lack of truthfulness or accuracy of these could cause. 

  1. Personal data of minors

Children under the age of 14 must not use the services offered by the website without the consent of their parents or guardians.

  1. Storage of personal data

Personal data will be kept until the actions that may arise from any relationship with Metro Málaga have expired, unless there is a legal obligation that extends the aforementioned storage period.    

  1. Sharing of personal data

Metro Málaga will be able to share personal data with; a)      Appropriate public bodies, State Security Forces and organisations and Judges and Courts, in compliance with its legal obligations.b)      Providers of services to Metro Málaga who act as data processors.

  1. International transfer of data

It is not anticipated that international transfers of data will be carried out.

  1. Exercising of rights and complaints

The user will be able to exercise their rights in terms of data protection (access, rectification or deletion, limitation, opposition, movement and not be the subject of automated individual decisions that could create legal issues for the user or significantly affect them in a similar way) by writing to Metro Málaga at; Camino de Santa Inés s / n, 29590 – Málaga, for the attention of the Legal Advice department, or by sending an email to dpd@metroMálaga.es, indicating in both cases your name, surname(s) and attaching a copy of a document proving your identity.

 

Notwithstanding the aforementioned, the user has the right to file a claim with the Spanish Data Protection Agency.
